2. General Terms of Site Usage and Services Offered.

Use of the site implies full and complete acceptance of the general terms of use described below. These conditions of use may be modified or supplemented at any time, therefore, users of the site are invited to consult them regularly.

This site is normally accessible to users at all times. However, the GoodPlanet Foundation may decide to make any interruption for technical maintenance, and it will then endeavor to communicate the dates and hours of the work to users in advance.

The site is updated regularly by the GoodPlanet Foundation communication team. Similarly, the legal notices may be modified at any time:they are nevertheless binding on users, who are asked to refer to them as often as possible in order to be informed about the notices.

3. Description of Services Provided.

The purpose of the site is to provide information concerning all activities of the GoodPlanet Foundation.

The GoodPlanet Foundation endeavors to provide information on the site which is as accurate as possible. However, it shall not be held liable for any omissions, inaccuracies and deficiencies in the update.

All information indicated on the site is given for illustrative purposes, and is subject to change.In addition, the information that appears on the site is not exhaustive. It is given subject to any modifications made since it was placed online.

4. Intellectual Property and Infringement.

The GoodPlanet Foundation owns the intellectual property rights or holds the rights of use on all the accessible elements on the site, in particular texts, images, graphics, logos, icons, sounds, software.

Any reproduction, representation, modification, publication, adaptation of whole or part of the elements of the site, regardless of the means or the process used, is prohibited without prior written authorization by the GoodPlanet Foundation.

Any unauthorized exploitation of the site or any of the elements which it contains will be regarded as constituting infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the Intellectual Property Code.

5. Management of Personal Data.

In France, personal data is specifically protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Criminal Code and the European Directive of October 24, 1995.

At the time when the site, is used the following may be collected: the URL of the links through which the user obtained access to the site, the provider of access to the user, and the Internet protocol (IP) address of the user.

In any event, the GoodPlanet Foundation collects personal information relating to the user only as necessary for certain services offered by the site. The user provides this information with full knowledge of the facts, in particular when the user itself inputs the data. At that time, the obligation or lack of an obligation to provide this information is indicated to the user of the site.

In accordance with the provisions in Articles 38 et seq. of Law 78-17 of January 6, 1978 relating to information technology, files and civil liberties, any user has a right to access, correct and challenge personal data relating to the user, by making a written and signed request, accompanied by a copy of the identification document with the signature of the holder of the document, specifying the address to which the response must be sent.

No personal information of the user of the site is published without the knowledge of the user, exchanged, transferred, assigned or sold on any medium to third parties.

The site is not reported to the CNIL — Commission Nationale de l’Informatique et des Libertés (National Commission for Information Technology and Civil Liberties) because it does not collect personal information.

The databases are protected by the provisions of the Law of July 1, 1998 transposing Directive 96/9 of March 11, 1996 relating to legal protection of databases.

6. Applicable Law and Assignment of Jurisdiction.

Any dispute related to use of the site is subject to French law. Jurisdiction is exclusively assigned to the courts of competent jurisdiction of Paris.
